TOBA — SEGARIS.CO – A CADRE of the PDI Perjuangan [PDIP] of Toba Regency, with the initials MS — who is also a member of the Toba DPRD leadership/member — has been DETAINED by the District Attorney’s Office (Kejari).
MS is suspected of not submitting an Annual Tax Return (SPT) for the 2017 and 2018 tax years, which is considered to violate tax provisions.
Head of the Intelligence Section of the Tobasa District Attorney’s Office, Benny Surbakti, explained that MS had undergone an examination related to the alleged tax crime.
MS has undergone the second stage of the case handling process by Civil Servant Investigators (PPNS) from the North Sumatra II Regional Office of the Directorate General of Taxes (DJP), Pematangsiantar region.
However, Benny Surbakti did not want to explain in detail, MS was detained regarding what tax return and how much state losses were due to the violation of the tax provisions.
“MS has been detained and placed in the Balige Detention Center (Rutan) on Thursday night at around 19.00 WIB. This detention is valid for the next two weeks,” said Benny Surakti when confirmed in his office, Friday (11/29/2024).
Legal basis and criminal acts
Benny Surbakti said that MS was suspected of violating Article 39 Paragraph (1) Letter c of Law Number 28 of 2007 concerning the Third Amendment to Law Number 6 of 1983 concerning General Provisions and Tax Procedures.
This article has been updated by Law Number 7 of 2021 concerning Harmonization of Tax Regulations, in conjunction with Article 64 of the Criminal Code. As an alternative, MS was also charged with Article 39 Paragraph (1) Letter d in the same law.
This case has attracted public attention, reflecting the Prosecutor’s Office’s firm commitment to prosecuting tax violations that are detrimental to the state.
Kejari Tobasa hopes that this action can be a warning for other taxpayers to comply with their tax obligations honestly and transparently.
